RELEASE OF LIABILITY/PUBLICITY AND ASSUMPTION OF RISK

PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING THIS DOCUMENT, YOU ARE GIVING UP LEGAL RIGHTS ON BEHALF OF YOURSELF AND/OR ANY MINOR PARTICIPANT.

In consideration of the opportunity to participate in The Buldak High Experience and related activities

(collectively, “the Event”), I agree on behalf of myself as follows:

  1. I certify that I am in good physical and mental health and have no known medical conditions, illnesses, or injuries that would prevent me from safely participating in the Event. I, the Participant, am 18 years of age or the age of majority in my jurisdiction of residence, whichever is greater, and I further acknowledge that the Released Parties are not responsible for any medical conditions that may arise before, during, or after the Event.
  2. I understand that participation in or attendance at the Event involves inherent and unavoidable risks, including but not limited to the risk to the Participant of accident, personal and bodily injury (including death) and property loss or damage, which may result from the Participant’s own actions or inactions, as well as the actions or inactions of others, or from the condition of the facilities, equipment and vehicles used at the Event. I have considered the nature and extent of the risks involved and I voluntarily choose, on behalf of myself and/or any minor Participant, to assume all such risks, even if the risks are not known to the Participant or me and are not reasonably foreseeable at this time, and I assume full responsibility for my and/or any minor Participant’s participation in the Event. In case of having minor Participants, as a parent/guardian of my child/ward, I allow my child/ward to participate in the Event under my control.  In consideration of my and/or any minor’s Participation in the Event, I hereby waive, release, and discharge the Released Parties from any and all liability, claims, demands, and causes of action, whether in contract, tort, or otherwise, arising out of or related to any injury, loss, or damage sustained by me and/or any minor Participant, including those resulting from the negligence of the Released Parties, to the fullest extent permitted by law. I further acknowledge that the Released Parties have no obligation to assess, verify, or ensure the physical or mental fitness of any minor for participation in the Event.
  3. I, for myself and/my personal representatives, heirs, estate, next of kin, insurers, assigns and anyone else who may make any claim for or on behalf of the Participant, hereby:
  1. Release, waive, discharge and covenant not to sue Samyang Foods Inc., Seongbuk-gu 104, Opaesan-ro 3-gil, Seoul 02735, South Korea (“Sponsor”), its partners, licensees, parent, affiliates, assigns, related companies, advertising and promotional agencies, successors and all entities involved in the development or execution of the Event or any related materials and their respective officers, directors, employees and representatives and agents (collectively, the “Released Parties”), in connection with any and all claims or causes of action arising from or relating to participation in the Event that any minor Participant or I may have for damages for personal or bodily injury, disability, death, loss or damage to person or property, even those arising from or relating to the negligence of any or all of the Released Parties, to the fullest extent permitted by law.
  2. Agree to indemnify, defend and hold harmless the Released Parties from and against any and all third-party claims, liabilities, losses, damages and expenses, including reasonable attorney’s fees, arising from or relating to my or any minor Participant’s participation in the Event.

I understand that the Event may be photographed, videotaped or otherwise recorded, and I agree that Released Parties(as defined below) may use the Participant’s actions, likeness, name and indicia of identity, appearance and biographical materials (collectively, “Likeness”) recorded in connection with the Event by digital means or by any other technology (“Image”); grant the Sponsor Entities a worldwide, royalty-free, perpetual license to use, exploit, print, publish, broadcast, reproduce, display and distribute the Image and my Likeness, alone, and in conjunction with any Sponsor related text or graphic content (collectively “Content”) on the internet via social media, without compensation. I understand that Likeness will be processed and stored securely in accordance with Sponsor’s Privacy Policy; will be retained only for as long as necessary to fulfill the purposes unless required by law or if retention is necessary for legitimate business purposes. I represent that I am at least 18 years of age or age of majority and I am the natural or legal parent/guardian of any minor with rights in the Content.

I have read this document and understand that I am giving up substantial rights by signing it. I sign this document freely and voluntarily, without any inducement or coercion.

I attest that I am in fact the parent or legal guardian of named participant(s). I hereby give my approval to this individual’s participation in the Event. I attest that if my dependent, the named participant(s), he or she will be accompanied by an adult eighteen (18) years of age or older throughout the entirety of his/her participation in the Event.
